ESA Applauds Prison Sentences for New York and Florida Game Pirates

Thursday, August 28th, 2008

August 28, 2008 – Washington, DC – The Entertainment Software Association today applauded the recent sentencings of two convicted pirates to significant prison time. These rulings send a clear message that intellectual property theft and game piracy are serious offenses. On August 20, 2008, U.S. District Judge Frank D. Whitney in the Western District of North Carolina sentenced Kevin Fuchs of West Amherst, NY, to eight months in prison, to be followed by eight months of home confinement during two years of court supervision. On August 15, 2008, U.S. District Judge T.S. Ellis III in the Eastern District of Virginia sentenced Kifah Maswadi of Oakland, FL, to fifteen months in prison, followed by three years’ supervised release and fifty hours of community service. Maswadi was also ordered to pay $415,900 in restitution.

“We commend the U.S. Department of Justice Criminal Division’s Computer Crime and Intellectual Property Section, the U.S. Attorney’s Offices for the Western District of North Carolina and the Eastern District of Virginia and the Federal Bureau of Investigation for their work in bringing these criminals to justice,” said Michael D. Gallagher, CEO of the ESA, the trade group representing U.S. computer and video game publishers. “These decisions illustrate, once again, that game piracy will not be tolerated and the extent at which these criminals will be prosecuted. The ESA and its members will continue to support law enforcement’s efforts to protect the intellectual property of our industry.”

On January 3, 2007, Fuchs plead guilty to conspiring to reproduce and distribute copyrighted works, including entertainment software. Fuchs played a key role in the “warez scene” where he was a “supplier,” whose role was to obtain pre-release copies of copyrighted software, and a “tester” who checked the functionality of pirated software after the copy protection was removed or bypassed by other warez scene members. This case was part of Operations Fastlink and Site Down, two of the largest piracy investigations conducted by the Federal Bureau of Investigation and the Department of Justice. The operations targeted “warez groups,” which illegally distribute copyrighted movies, games, software and movies online.

The Federal Bureau of Investigation field office in Charlotte, NC, handled the investigation of defendant Fuch’s activities. Trial Attorneys Richard D. Green and John Zacharia of the U.S. Department of Justice Criminal Division’s Computer Crime and Intellectual Property Section, Assistant U.S. Attorney Eric Klumb, along with Assistant U.S. Attorney Corey Ellis of the Western District of North Carolina, handled the prosecution.

The Fuchs sentencing comes on the heels of a fifteen month sentence imposed on a Florida game pirate. On June 3, 2008, Kifah Maswadi pleaded guilty to one count of criminal copyright infringement. He admitted to selling “Power Players,” which are game systems that connect directly to a television and were pre-loaded with at least 76 pirated copies of video games. From 2006 to 2007, Maswadi sold these game systems containing illegal copies of games via the Internet and earned more than $390,000 through this illegal activity. Maswadi was facing up to three years in prison but received a reduced sentence for cooperating with the government.

The Federal Bureau of Investigation field offices in Washington, DC, Tampa, FL, and Jacksonville, FL, handled the investigation of defendant Maswadi’s activities. Assistant U.S. Attorney Jay V. Prabhu and Trial Attorney Tyler G. Newby of the U.S. Department of Justice Criminal Division’s Computer Crime and Intellectual Property Section handled the prosecution.

The Entertainment Software Association is the U.S. association dedicated to serving the business and public affairs needs of companies publishing interactive games for video game consoles, handheld devices, personal computers, and the Internet. License deal with book publisher Scholastic will see release of Horrible HistoriesTM branded titles

Slitherine is pleased to announce that it has signed a worldwide licensing agreement with The Copyrights Group to develop Horrible Histories™ games, for platforms such as PC, DS and Wii. The deal, brokered by Chorion’s new media consultants, AT Brands (a division of AT New Media), will see the games ready for release in time for Spring 2009.

With international book sales of over 20 million copies since 1993, Horrible Histories™ is one of the world’s bestselling history book series for children. By focusing on the bits kids don’t get taught at school, author Terry Deary and illustrator Martin Brown have made history entertaining and accessible for generations of children. Used within a computer game, that ethos is set to provide families with the ideal entertainment – and learning – experience.

“The Horrible Histories books offer a wealth of written and illustrative material for Slitherine Strategies to work with and bring the brand to life off the page,” commented Zoe Upcraft, Licensing Manager at Chorion. “This interactive deal complements the TV deal agreed last year between Scholastic Entertainment and Lion TV. Lion TV will produce 13 live action episodes broadcast by the BBC next Spring.”

Lisa Edwards, Editorial Director, Non-Fiction and Licensed Properties, at Scholastic said: “Slitherine are experts in historical computer gaming and we are delighted to have found the right home for our brand. Die-hard Horrible Histories fans have been waiting for an exciting gaming extension of the brand – and if we can attract children who are primarily gamers to the books then that will indeed be a bonus.”

Marco Minoli, Director of Marketing at Slitherine said: “Extending our line-up of interactive games based on History to new frontiers is our main objective. Exploring this very specific sector, to bring a different type of fun and entertainment to this great brand through videogames is one of our most exciting ventures for next year. This is a great opportunity to show how we are able to work with such a powerful property.”

Simon Kay Business Development Director at AT New Media added, “Once again the AT Brands division has been able to be creative in its thinking in bringing together two like-minded companies who can fully exploit the interactive games potential of the Horrible Histories brand. It has been a pleasure working on this initiative and bringing Slitherine and Scholastic together on what we hope will be a tremendously successful project”.

“POSTAL – The Movie” NOW on DVD!

Vivendi to Release Special Edition of Film on August 26th

Tucson, AZ: After almost two years of anticipation and anxiety, the long-awaited DVD release of “POSTAL—The Movie” is now. Director Uwe Boll’s first film to draw critical raves has fans that both saw the film in theaters or heard the word second hand ready to pick up and treasure their very own copy of the outrageous satire, inspired by Running With Scissors’ legendary videogame franchise.

The film is based primarily on the POSTAL 2 storyline and stars Zack “Scut Farkis” Ward as the Postal Dude along with Dave “NewsRadio” Foley, Larry “Soup Nazi” Thomas and Verne “Mini-Me” Troyer. Fans will also get a kick out of cameos by RWS honcho Vince Desi and Uwe Boll as the lederhosen clad proprietor of a Bavarian, crypto-Nazi theme park.

Vivendi has officially announced its DVD rollout for August 26th, with an MSRP of $26.99 (Rated and Unrated versions). Extras include a Uwe commentary, deleted scenes, special features (“Raging Boll” and an Indiana Jones spoof starring Troyer) along with a copy of the PC version of POSTAL 2 as well as the multi-player POSTAL 2: Share the Pain. A Blu-ray edition (with identical extras) will also be available to play on your PS3 or other Blu-ray DVD for a MSRP of $34.99.

“Own a piece of history! Only buying the DVD will get you the full complete outrageous movie and game, sadly the rental version is edited down and doesn’t include the infamous Postal games-so don’t get beat renting it.” explained Vince Desi. “The Postal Movie on DVD means EVERYONE will have the opportunity to see it, even Usama Bin-Laden from his cave won’t want to miss this.”

The POSTAL film and videogames package will be available at a wide range of retail outlets, including Walmart, Best Buy, Borders, Amazon, Hastings and Virgin.

For more information on Postal games and gear, as well as updates on the development of POSTAL III visit our new expanded site www.gopostal.com and be sure to visit PostalNation.net for in-depth coverage of the RWS scene.

p.s. I picked up a copy of the Unrated version for much less than the 26.99 MSRP. Good to have a new shiny copy of Postal 2 and STP as well :) I’ll add the movie on my “to review” pile as well as a retro review for Postal 2.

We want to move from strictly placing ads to an online-services model that benefits everyone.” He further added, “Partnering with BigWorld is instrumental in helping us to achieve our technological and business goals in the best and most cost efficient manner”.

I’m both glad and honored to be joining a company that is building the best possible MMO tech coupled with an intense focus on customer support. I’m looking forward to translating and extending our successes in Asia and the U.S. here to the European and Russian markets.”
